Are Court Records Public in Lincoln County?
Under § 408-A of the Maine Freedom of Access Act (FOAA), any person has the right to inspect and copy public records within a reasonable time after submitting a request. Court records are generally presumed open, but Maine law carves out a significant list of protected categories.
Under § 432 of the FOAA and applicable court rules, the following types of records are restricted from general public access:
- Mental health civil commitment proceedings
- Medical malpractice screening panel proceedings
- Sterilization and HIV/AIDS testing proceedings
- Minor settlement proceedings
- Child protection matters and adoptions
- Guardianships of minors

Lincoln County Criminal Court Records

Criminal History Records
Criminal case records maintained by the courts are not the same as an individual’s criminal history. For a formal background check, the Maine State Police State Bureau of Identification (SBI) maintains the state’s central repository of criminal history record information. The SBI’s online public search tool, accessible at maine.gov/pcr, releases conviction and adjudication information for adult crimes. The fee for a criminal history record request is $31.00 (or $21.00 for inforME subscribers). The SBI only releases conviction information through public channels; non-conviction data is restricted to authorized agencies.
Arrest Records

Marriage Records
Certified copies of marriage records are considered private for records less than 50 years old. The fee structure mirrors that of divorce records: $15.00 for the first certified copy and $6.00 for each additional copy. Birth and Death Records
Birth records under 75 years old are confidential under Maine law; those 75 years of age and older are public records available to any requester as informational copies. Death records are public after 25 years; fetal death records are public after 50 years. Records below those thresholds are confidential and limited to authorized requesters. Lincoln County Probate Court Records

Certain probate filings that contain sensitive financial or personal information may be restricted from public inspection. The Register can advise on the availability of specific documents.
The Probate Court also serves as a passport acceptance facility. Passport applications are accepted by appointment only; photo services are available at the office for a $15.00 fee. Applicants should call ahead before visiting for passport services.
